The terms that apply when you create an account or use the Menju app as a restaurant business.

By creating an account or using our app, you agree to these terms of use.

Contracting party

The service is aimed at companies and organizations in the restaurant industry. By creating an account, you confirm that you're doing so in your professional capacity, as an authorized representative of the restaurant business you represent, and not as a private individual. The agreement is therefore entered into between us and your restaurant business as a trader (näringsidkare), which means that consumer protection legislation — such as the Swedish Distance and Off-Premises Contracts Act (distansavtalslagen) and the Swedish Consumer Sales Act (konsumentköplagen) — does not apply.

Your responsibility

You're responsible for making sure the information you provide is accurate, and for using the service in a way that complies with applicable laws and regulations.

Availability & changes

We reserve the right to update, change, or discontinue parts of the service. We aim to inform you of material changes in advance and can't guarantee uninterrupted availability.

Operations and availability disclaimer

We aim to keep the service available around the clock, but we can't guarantee that it will always be free of interruptions, errors, or delays. Planned maintenance is announced in advance where possible. We're not liable for outages caused by factors outside our control, such as outages at our subprocessors (Google Cloud or Stripe) or your internet connection.

Prohibited use

You may not use the app for unlawful purposes or in a way that could harm us or other users. Misuse of the service may result in account suspension or legal action.

Limitation of liability

The service is provided "as is." To the extent permitted by law, we're not liable for indirect damages, lost profit, lost data, or other consequential damages arising from your use of the service. Our total liability to you is in all cases limited to the amount you've paid for the service in the past three (3) months.

Force majeure

We're not liable for delays or deficiencies in the service caused by circumstances outside our control, such as outages at our subprocessors (such as Google Cloud or Stripe), natural disasters, war, labor disputes, fire, government decisions, or other events of a force majeure nature.

Our right to suspend or terminate accounts

We reserve the right to suspend or terminate your account, with immediate effect, if you breach these terms of use, misuse the service, or if we have reasonable grounds to suspect fraudulent conduct. Where possible, we'll notify you in advance, unless the circumstances require us to act immediately.

Governing law & disputes

These terms are governed by Swedish law and apply between us and you as a trader. Because the agreement is entered into between two businesses, the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN) has no jurisdiction to hear any dispute — instead, a dispute that can't be resolved amicably is settled by the general courts.

Intellectual property

All content you upload to the application — such as menus, images, and text — is owned by you or the restaurant business you represent. By uploading content, you grant us a non-exclusive right to use, store, display, and process the content to the extent needed to provide and develop the service — for example, to display your menu to your guests. You're responsible for ensuring that the content you upload doesn't infringe any third party's rights.
